Heather Hanson Homes, LLC — TERMS OF PURCHASE
Last updated: October 8, 2026
Please read these Terms of Purchase ("Terms") carefully before completing your purchase of any product or service from Heather Hanson Homes, LLC (the "Company", "we", "our").
By purchasing from the Company, you agree to abide by these Terms and our Website Terms & Conditions, Privacy Policy, and Disclaimers (collectively, these "Terms"). If you disagree with any part of these Terms, you should not complete your purchase.
Order of precedence. Where the Company provides a separate written services agreement for a particular Service, such as the Home Flow Consult Agreement, and that agreement is signed by both parties, that agreement controls as to that Service to the extent of any conflict with these Terms. In all other cases, in the event of any conflict between these Terms and the Website Terms & Conditions, Disclaimers, or Privacy Policy, these Terms shall control.
You must be at least 18 years of age or older to purchase from the Company.
PRODUCTS AND SERVICESThe Company offers two categories of offerings, which are treated differently under these Terms.
"Products" are educational materials sold on a self-directed basis, including the Home Flow Lab and the Home Flow Method. Products may include access to an online, password protected platform containing video, audio, or written lessons, templates, guides, checklists, slide decks, and other training materials, or downloadable resources delivered via email or sharing links, as described on the sales and checkout pages for each Product. The specific contents of a Product are subject to change, and the Company makes no guarantees that any particular resource will be available at any given time.
"Services" are engagements in which the Company performs work specific to an individual purchaser and that purchaser's home, including the Flow Plan Review and the Home Flow Consult. Services are performed by Heather Hanson, a licensed architect in the State of Colorado, and are subject to the Scope of Services section below.
References to "Product(s)" in these Terms include Services except where a provision expressly applies to one category only.
From time to time, the Company will offer bonuses to individuals who purchase certain Products. You shall be entitled to any bonuses offered to you at the time of your enrollment. Bonuses are not guaranteed to be available for the entire lifespan of the Product and they vary depending on specific live and automated promotions throughout the year. If the offered bonus is a product that you already purchased, you will not be entitled to a refund of the purchase price for the product or any other compensation in place of the offered bonus.
SCOPE OF SERVICESThe Company provides residential design education and virtual design consulting. Deliverables consist of flow plans, being diagrammatic and scaled floor plans indicating rooms, circulation, zones, drop zones, and spatial relationships, together with related instruction, written summaries, and recorded commentary.
The Company does not provide, and all Products and Services expressly exclude:
- Construction documents, working drawings, or a permit set
- Stamped, sealed, or signed drawings of any kind
- Permit applications or submittals
- Building code, zoning, or land use analysis
- Structural engineering, including beam sizing, load calculations, and foundation design
- Mechanical, electrical, or plumbing engineering
- Interior design, finish selection, cabinetry specification, furniture, or sourcing
- Cost estimates, quotes, or bids
- Construction administration, contractor selection, bidding, or project management
- New construction design and stock or custom house plans
- Any in-person service, including site visits, inspections, surveys, and measurement
You are solely responsible for engaging appropriately licensed professionals in your own jurisdiction for any work requiring licensure there, including permit drawings, structural design, and code compliance review. The Company will identify circumstances in which it believes such professionals are required, but the Company's failure to identify any such circumstance does not relieve you of this responsibility.
NO IN-PERSON INSPECTIONAll Services are performed remotely. The Company does not visit, inspect, survey, or measure your property, and relies entirely on information, photographs, measurements, and descriptions that you provide.
Conditions that are not visible or disclosed in the information you provide cannot be identified by the Company and are not accounted for in any deliverable. These include, without limitation, concealed structural conditions, undisclosed prior work, non-compliant or unpermitted construction, water or pest damage, hazardous materials, and the actual location of structural, mechanical, electrical, and plumbing elements within walls, floors, and ceilings.
Any identification by the Company of a wall, structural element, system, or building condition as load-bearing, non-structural, movable, or otherwise is an informed professional opinion based on limited remote information and must be independently verified on site by a qualified contractor, licensed structural engineer, or building official before any demolition, alteration, or construction is undertaken.
Any cost figures, ranges, or relative comparisons provided are general planning references only. They are not quotes, estimates, or bids, and actual costs vary substantially by market, site conditions, scope, and contractor.
YOUR RESPONSIBILITIESIf you purchase a Service, you agree to:
- Provide accurate and complete information about your home, including measurements, photographs, and a truthful description of how the home is used. The quality of any deliverable depends directly on the accuracy of what you provide.
- Independently verify any structural, mechanical, electrical, plumbing, code, or zoning matter with a qualified professional in your jurisdiction before undertaking work.
- Obtain all required permits, approvals, and inspections.
- Make your own decisions about what to build, whom to hire, and what to spend. The Company provides design guidance. It does not make these decisions for you and is not a party to any agreement between you and any contractor, builder, lender, or other professional.
PAYMENT POLICYIn consideration for your access to the Product(s), you agree to pay the full purchase price (including all applicable sales and other taxes or fees) as indicated on the sales and checkout pages, either in a single payment or, where offered, through a payment plan, and to provide the Company with a valid credit card, debit card, or other payment method.
Payment Plans. Where the Company offers a payment plan for a Product, you may pay the purchase price in the number of installments, in the amounts, and on the schedule stated on the checkout page at the time of purchase. The total paid under a payment plan may be higher than the single-payment price. A payment plan is a method of paying for a Product you have purchased. It is not a subscription, and it cannot be cancelled to avoid the remaining installments. By selecting a payment plan, you authorize the Company to charge your payment method automatically for each installment when it comes due, and you agree to pay all installments regardless of whether you access or complete the Product.
Failed Payments. If an installment cannot be collected, the Company may retry the charge and will notify you by email. If the installment remains unpaid seven (7) days after its due date, the Company may suspend your access to the Product until your account is brought current. If the installment remains unpaid thirty (30) days after its due date, the Company may terminate your access, and amounts already paid will not be refunded. You are responsible for keeping your payment information current.
Upgrades and Credits. Where the Company offers a credit or upgrade price based on a prior purchase of the Home Flow Method, the credit is based on the single-payment price of the Home Flow Method, regardless of the payment option you selected. All installments under a payment plan must be paid in full before you purchase a Flow Plan Review or upgrade to a Home Flow Consult.
To complete your purchase, you may be asked to supply certain information relevant to your purchase including, without limitation, your credit card number, the expiration date of your credit card, and your billing address. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and (ii) the information you supply to the Company is true, correct and complete.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected, including purchases made with pre-paid credit cards. The Company reserves the right to refuse or cancel your order at any time for any reason, including but not limited to availability, errors in the description or price, or errors in your order. If the Company cancels your order for any reason other than your breach of these Terms, your sole remedy is a full refund of amounts paid.
We may use third party services for the purpose of facilitating payment and the completion of your purchase. By submitting your information, you grant the Company the right to provide your payment information to these third parties subject to our Privacy Policy.
REFUND POLICYExcept as expressly provided below, due to the digital and informational nature of the Product(s), all sales are final and no refunds will be issued.
Home Flow Method Completion Guarantee. A purchaser of the Home Flow Method may request a refund within thirty (30) days of the date of purchase, provided that the purchaser has (a) completed Modules 1 through 4 of the Home Flow Method, and (b) submitted the completed worksheets corresponding to those modules to the Company. Requests that do not satisfy both conditions will not be granted. Requests must be made in writing to hello@heatherhansonhomes.com within the thirty (30) day period. For a purchase made under a payment plan, the date of purchase is the date of the first installment, a granted refund consists of all amounts paid to date, and any remaining installments will be cancelled. This guarantee applies solely to the Home Flow Method.
All other Products and Services are non-refundable, including the Home Flow Lab, the Flow Plan Review, and the Home Flow Consult. Because the Flow Plan Review and the Home Flow Consult require the Company to reserve limited capacity and to perform work specific to the purchaser, no refunds will be issued once materials have been submitted or a session has been scheduled, whichever occurs first.
Where a signed services agreement sets out different cancellation or refund terms for a particular Service, those terms apply to that Service in place of this paragraph.
If you experience any difficulties accessing, retrieving, or downloading your purchased Product(s), contact the Company immediately at hello@heatherhansonhomes.com.
SCHEDULING, SUBMISSION, AND EXPIRATIONFlow Plan Review. Your Review begins when your completed materials are received, not when you purchase. The Company's stated turnaround time runs from the date complete materials are received. Materials must be submitted within six (6) months of purchase. If materials are not received within that period, the purchase expires and no refund will be issued, although the Company may at its sole discretion honor a late submission.
Home Flow Consult. Your first session must be scheduled within sixty (60) days of purchase and must occur within six (6) months of purchase. Sessions may be rescheduled with at least forty-eight (48) hours' notice. A session missed without such notice, or a no-show, may be treated as delivered at the Company's sole discretion, given the limited number of engagements the Company accepts each month.
Revisions. The Home Flow Consult includes one (1) round of revisions to the flow plan, meaning a single consolidated set of requested changes following delivery of the draft plan. Requests must be submitted within thirty (30) days of delivery. Additional revisions, redesigns, or changes arising from information not provided before the design was prepared may be quoted separately.
Completion. An engagement is considered complete upon delivery of the final deliverable, or six (6) months after purchase, whichever occurs first.
Where a signed services agreement sets out different scheduling, revision, or completion terms for a particular Service, those terms apply to that Service in place of this section.
PRODUCT ACCESS AND AVAILABILITY1. Term of AccessYour access to a Product begins upon completion of your purchase and will continue for the lifetime of that Product, but no less than thirty (30) days. The Company reserves the right to discontinue any Product and terminate your access at any time for any reason. No refunds will be granted if a Product is discontinued. The Company makes no guarantees about the ongoing availability of any Product. In the event that the Company decides to discontinue any given Product, you will receive thirty (30) days' notice and an opportunity to download certain resources. If you purchased a Product under a payment plan, your continued access is conditioned on timely payment of each installment, as described in the Payment Policy above.
2. AvailabilityThe Company does not own the online course platform, video conferencing software, scheduling software, file storage services, or other third-party software by which the Product(s) are provided and delivered. Your access may sometimes be subject to interruption or delay outside of our control. Due to the nature of the Internet and electronic communications, we do not make any warranty that the Product(s) or any associated resources or services will be error-free, without interruption or delay, or free from defects in design. We will not be liable to you should any of the third-party software we use become unavailable, interrupted, or delayed for any reason.
DISCLAIMEREducational ProductsThe information contained in the Products is provided for educational purposes. The Products are instructional materials and are not a substitute for advice from a professional who is aware of the facts and circumstances of your individual situation, including the physical condition of your home. Nothing in the Products should be understood as a recommendation that you not consult with a licensed professional about your particular situation. The Company expressly recommends that you do so.
The Products should not be construed as medical, legal, financial, tax, or insurance advice.
ServicesThe Company's Services are performed by a licensed architect and constitute professional design guidance within the scope described in the Scope of Services section above. They are expressly limited to that scope. Nothing in a Service constitutes construction advice, structural engineering, building code analysis, permitting guidance, cost estimation, or any service requiring licensure in a jurisdiction where the Company is not licensed.
Your purchase of a Service does not create any relationship, obligation, or duty beyond the delivery of the specific deliverables described on the sales page for that Service and in these Terms.
Your Personal ResponsibilityBy using the Product(s), you accept personal responsibility for the results of your actions. You assume all risk of your access to the Product(s) and any subsequent actions you choose to take. You agree to take full responsibility for any harm or damage you suffer as a result of the use, or non-use, of the information available in the Product(s). You agree to use judgment and conduct due diligence before taking any action or implementing any plan, design, or recommendation.
CONFIDENTIALITYYou agree to respect the Company's confidential information. The content of the Product(s) contains our proprietary methods, forms, templates, and other information. You agree not to share the materials provided to you in the Product(s) with anyone other than the Company and other purchasers of that Product.
Permitted Use of Work Product. Nothing in this section restricts you from sharing (a) the floor plans, sketches, worksheets, or other materials you personally create using the Product(s), (b) any deliverable the Company prepares for you under a Service, or (c) templates and communication materials the Company expressly provides for that purpose, with contractors, builders, architects, engineers, lenders, real estate professionals, or other parties engaged in connection with your own home. You may not distribute the Company's instructional videos, blank worksheets, or other course materials except as provided above.
YOUR MATERIALS
Client Materials. Materials you provide to the Company in connection with a Service, including photographs of your home, floor plans, measurements, addresses, and descriptions of your household and its routines ("Client Materials"), remain yours. You grant the Company a limited license to use Client Materials solely for the purpose of performing the Service you purchased and maintaining its records.
The Company will not publish, display, or otherwise use Client Materials publicly, or as an example, case study, testimonial, or teaching material, without your separate written permission. Permission may be given or withheld for any reason, may be given on an anonymized basis, and may be withdrawn at any time as to future use.
Retention. Client Materials are stored in access-restricted cloud storage and retained for seven (7) years following completion of your engagement, after which they are deleted. The Company may retain Client Materials for a longer period where a claim arising from the work remains possible under applicable law, or where retention is required by law, by the Company's insurers, or by the rules governing the Company's professional license.
You may request deletion of your Client Materials at any time by emailing hello@heatherhansonhomes.com. The Company will honor such requests except as to materials it reasonably needs to retain in order to comply with a legal obligation or to establish, exercise, or defend a legal claim. Where the Company retains materials on that basis, it will not use them for any purpose other than those stated.
Voluntary Submissions. If you voluntarily submit a testimonial, review, comment, photograph, or other material to the Company for promotional purposes, or post one publicly, you grant the Company a non-exclusive, royalty-free license to republish that submission in whole or in part, with attribution as you provided it, unless you state otherwise at the time of submission. You must own the rights to any image you submit.
Recording. Sessions conducted as part of the Home Flow Consult are recorded by the Company for the purpose of preparing deliverables and providing you with a record of the engagement. By scheduling a session, you consent to that recording. Recordings are Client Materials and are governed by this section, including the requirement of separate written permission for any public use. If you do not wish a session to be recorded, notify the Company in advance.
INTELLECTUAL PROPERTY
The Product(s) contain intellectual property owned by the Company, including trademarks, copyrights, proprietary information, and other intellectual property, such as text, video, graphics, design, logos, images, and the compilation thereof. The Company name, the Company logo, the Company slogan, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. The Company reserves all rights in and to its common law and registered trademarks, service marks, copyrights, and other intellectual property rights, and to all intellectual property included in the Product(s) ("IP").
All other names, logos, product and service names, designs and slogans are the trademarks of their respective owners.
Your purchase does not result in a transfer of any intellectual property to you, except as provided below. As a condition of your purchase and use of the Product(s), you agree to observe and abide by all copyright and other intellectual property protection. The Company grants you a non-exclusive, non-transferrable, revocable, royalty-free license to access and use the Product(s) for your personal or internal business use. You agree that you will not modify (except as necessary for completing or filling out templates or forms for your authorized use), publish, transmit, reverse engineer, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the content found in the Product(s), or offer any competing product or service based upon information contained in the Product(s).
Deliverables. Upon full payment, you receive a perpetual, non-exclusive license to use any flow plan or other deliverable the Company prepares for you under a Service, for the purpose of planning, permitting, and constructing work on the home for which it was prepared, including providing copies to your contractors and design professionals. The Company retains copyright in its deliverables and in the underlying methods and drawing conventions. Deliverables may not be resold, licensed, or used for any other property.
The Company's content is not for resale. Your purchase does not entitle you to make any unauthorized use of the IP. You agree not to delete or alter any proprietary rights or attribution notices. You agree that you do not acquire any ownership rights in the IP. The Company does not grant you any licenses, express or implied, except as expressly authorized herein.
You agree that any infringement of the Company's IP shall result in immediate termination of the license granted in these Terms. If you make any unauthorized use of the Company's IP, your access will be terminated immediately and you shall not be entitled to a refund of any portion of the purchase price.
EQUITABLE RELIEFYou acknowledge and agree that in the event of a breach or threatened violation of the Company's intellectual property rights and confidential and proprietary information by you, the Company will suffer irreparable harm and will therefore be entitled to injunctive relief to enforce these Terms. The Company may, without waiving any other remedies under these Terms, seek from any court having jurisdiction any interim, equitable, provisional, or injunctive relief necessary to protect its rights and property pending the outcome of the mediation referenced below. You hereby irrevocably and unconditionally consent to the personal and subject matter jurisdiction of the federal and state courts in the State of Colorado for purposes of any such action by the Company.
LIMITATION OF LIABILITYExcept as expressly provided in these Terms, the Company makes no guarantees, representations or warranties of any kind or nature, express or implied, with respect to the Product(s). In no event shall the Company be liable to you for any direct, indirect, consequential or special damages, including without limitation any liability for any accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease, condition or issue, physical, mental, emotional, or spiritual injury or harm, loss of income or revenue, loss of business, loss of contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted time, and for any other loss or damage of any kind, however and whether caused by negligence, breach of contract, or otherwise, even if foreseeable.
Without limiting the foregoing, the Company shall not be liable for: damage to real or personal property; construction costs, cost overruns, or change orders; delays in construction; the acts, omissions, workmanship, or performance of any contractor, builder, engineer, designer, or other party you engage; the discovery of concealed or undisclosed conditions; denial or delay of any permit or approval; or any decision you make regarding your home.
The Company's entire liability for any breach of these Terms, and your sole remedy, shall be limited to the purchase price actually paid by you to the Company.
NO WARRANTIESWE MAKE NO WARRANTIES AS TO THE PRODUCT(S). YOU AGREE THAT THE PRODUCT(S) ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCT(S) WILL BE FUNCTIONAL, UNINTERRUPTED, CORRECT, COMPLETE, APPROPRIATE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PART OF THE PRODUCT OR CONTENT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE PRODUCT(S) IN TERMS OF THEIR CORRECTNESS, ACCURACY, TIMELINESS, RELIABILITY OR OTHERWISE.
FEEDBACK AND CONCERNSIf you are dissatisfied with any Product or Service, you agree to notify the Company at hello@heatherhansonhomes.com and to give the Company a reasonable opportunity to address your concerns. Nothing in these Terms restricts your ability to publish a truthful review of your experience with the Company.
INDEMNIFICATIONYou shall indemnify and hold the Company harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses, as well as third party claims and causes of action, including, without limitation, attorney's fees, arising out of your breach of any of these Terms, your use of the Product(s), your failure to maintain the confidentiality and/or security of your password or access rights, or any construction or alteration work undertaken at your property. You shall provide the Company with such assistance, without charge, as we may request in connection with any such defense, including, without limitation, providing the Company with such information, documents, records, and reasonable access to you as we deem necessary. You shall not settle any third-party claim or waive any defense without our prior written consent. You recognize and agree that the Company's owners, officers, employees, shareholders, trustees, affiliates, and successors shall not be held personally responsible or liable for any actions or representations of the Company.
FORCE MAJEURE
The Company shall not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in fulfilling or performing any term of these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of the Company including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion, or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, pandemic or epidemic, lock-outs, strikes or other labor disputes, serious illness or family emergency affecting the Company's sole practitioner, or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, or telecommunication breakdown or power outage.
In the event of such a delay affecting a Service, the Company will notify you promptly and will either reschedule or, at the Company's discretion, refund amounts paid for work not yet performed.
CHANGES
The Company reserves the right at any time to modify these Terms and to impose new or additional terms or conditions on your use of the Product(s). Such modifications and additional terms and conditions shall be effective immediately and incorporated into these Terms, except that modifications shall not apply retroactively to a Service already purchased. Your continued use of the Product(s) will be deemed your acceptance of such changed terms. The changes may be listed in an area accessible to you or you may be notified by either e-mail or postal mail. If you have any questions regarding modified terms, please contact us at hello@heatherhansonhomes.com.
EFFECT OF HEADINGS; SEVERABILITY
The subject headings of the paragraphs and subparagraphs of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions. If any portion of these Terms is held to be unenforceable or contrary to law, such portion shall be construed in accordance with applicable law so as to best accomplish the objectives of the original provision to the fullest extent allowed by law, and the remainder of the provisions shall remain in full force and effect.
ENTIRE AGREEMENT; WAIVERThese Terms, together with the Privacy Policy and Disclaimers, constitute the entire agreement between you and the Company pertaining to the Product(s) and supersede all prior and contemporaneous agreements, representations, and understandings between us. Any waiver by the Company of a breach of or right under these Terms will not constitute a waiver of any other or subsequent breach or right. No waiver shall be binding unless executed in writing by the Company.
ALTERNATIVE DISPUTE RESOLUTIONYou agree to notify the Company of any concerns or issues regarding the Product(s), and to give the Company an opportunity to resolve those concerns or issues. If you and the Company cannot find a resolution to a dispute or potential claim by means of good-faith negotiation, then you explicitly agree to make a reasonable attempt to resolve any such dispute through Alternative Dispute Resolution or Mediation before filing a civil cause of action. You agree that your good faith participation in Mediation or other Alternative Dispute Resolution is a condition precedent to filing any civil cause of action.
GOVERNING LAW; JURISDICTION
These Terms shall be construed in accordance with, and governed by, the laws of the State of Colorado, and the courts of Colorado shall have jurisdiction to hear and determine any dispute arising in relation to these Terms. You agree that any proceeding relating to the Product(s) must be filed exclusively in the appropriate courts located in Montezuma County, Colorado, and you submit to the jurisdiction of those courts and waive any objection based on an inconvenient forum or other reasons.
ALL RIGHTS RESERVEDAll rights not expressly granted in these Terms are reserved by the Company.
